terms & Waiver
By registering for Elements Urban Arts Collective/Elements Dance Company, you are agreeing to all the following payment terms, waiver of liability, and program policies and procedures listed here or within your company paperwork. You are also confirming you have received a copy of the program schedule.

PAYMENT TERMS
All payments made to Elements Urban Arts Collective/Elements Dance Company are non-refundable and non-transferable. If dancer decides to cancel participation after registration, dancer will forfeit registration fees and any tuition already collected.
WAIVER OF LIABILITY
ELEMENTS URBAN ARTS COLLECTIVE, LLC is permitting the participant to enroll and participate in dance classes, rehearsals, performances, events associated with ELEMENTS DANCE COMPANY and by signing below, hereby voluntarily indemnifies, releases from liability, and holds harmless ELEMENTS URBAN ARTS COLLECTIVE, LLC, its owners, agents, employees, volunteers, sponsors, independent contractors, personnel, performance organizers, facility where activity/class is held including online platforms (Zoom, IGLive, YouTube, Vimeo, Facebook, etc), and any of these parties’ insurance companies, (collectively the “Released Parties”), for any accident, injury, illness, death, loss, damage to person or property or other consequences suffered by Participant or any other person arising or resulting directly or indirectly from Participant’s participation in the dance classes. In the event that Participant is injured, Participant agrees to assume any financial obligation, either through Participant’s personal health insurance, or through some other means, for any medical costs which Participant incurs. The Released Parties assume no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with the use of any facilities or services in connection with the Activity.
IT IS THE INTENTION OF PARTICIPANT BY SIGNING BELOW TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF THE RELEASED PARTIES AND TO EXEMPT AND RELIEVE THE RELEASED PARTIES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.
Participant further agrees that Participant will not make any claim against, sue or attach the released parties for any loss or damage resulting from Participant’s involvement in the activity. PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN DANCE ACTIVITIES. PARTICIPANT AGREES THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF THE PARTICIPANT’S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND ELEMENTS URBAN ARTS COLLECTIVE, LLC AND PARTICIPANT SIGNS IT OF HIS/HER OWN FREE WILL.
Certification of Health. I certify that I am in proper physical and mental health to be a spectator or participant in the dance activities I engage in now and into the future, and acknowledge my responsibility to cease activity if my health status precludes my ability to safely be a spectator or participant. I agree to notify my instructor in every class of any medical condition that may affect my ability to safely participate in dance activities. I also agree to notify my instructor of any medical condition which might be aggravated by participation in dance activities, or which subjects me to increased risk of harm by participating. I also agree to assume the risk of aggravating any preexisting medical conditions by participating. I also agree to assume the risk of participating despite known and unknown medical conditions.
Minors. All certifications or promises in this Agreement referencing “I” or otherwise to me, I am additionally making on behalf of any minors for whom I am signing. For example, by waiving the right for my heirs, spouse, children, representatives, executors, administrators, or assigns to bring a claim on my behalf, I am agreeing to the same waiver on behalf of any minors for whom I am signing, and thus eliminating the cause of action another parent or guardian might otherwise be able to bring against the Released Parties. I further agree to explain the risks and rules of the facility and to ensure my child or ward follows those rules. I also understand that I am personally indemnifying the Released Parties for claims the minor or their parent(s)/guardian(s) might have against the Released Parties for negligence.

Media Release
I agree that I may be videotaped, audio recorded and /or photographed during class, rehearsal, events, and performance and that ELEMENTS URBAN ARTS COLLECTIVE, LLC may use and modify the images and/or recording for any and all uses, including but not limited to advertisement and marketing without any compensation and in perpetuity.
Rules. I acknowledge that copies of this Agreement are freely available to me. I also agree to abide by the rules set forth ELEMENTS URBAN ARTS COLLECTIVE, LLC for participants and spectators, and acknowledge that I have received a copy of such rules and know where updated rules are posted.
